Terms and Conditions of Sale – Mtrade9

Online sales carried out through the website https://mtrade9.com/ are considered distance sales.

1. Definitions

Online sales contract: a distance contract concerning tangible movable goods offered on Mtrade9, concluded between the Supplier and the Purchaser.

Purchaser: the natural person acting for purposes unrelated to their business, commercial, or professional activity (consumer).

Mtrade9: the brand and website that promote the sale of goods.

Supplier/Seller: the company responsible for the sale of the goods covered by the contract.

2. Identification and obligations of the parties

Supplier: the goods offered on Mtrade9 are sold by the company indicated in the official contact and legal sections of the website:

Purchaser: expressly declares to purchase as a consumer and undertakes not to resell the products for commercial purposes.

3. Subject matter and conclusion of the contract

The tangible movable goods displayed on Mtrade9 constitute an offer to the public.

The contract is concluded exclusively online, through the completion and submission of the order form on the website and subsequent confirmation via email by the Supplier.

4. Payment methods and refunds

The following payment methods are accepted (where available):

• Cash on delivery (COD);
• Bank transfer;
• PayPal;
• Credit and debit cards (data processed directly by banking/payment institutions).

Any refunds will be made within 30 days from the acknowledgement of the right to a refund, using the same payment method used for the original transaction, unless otherwise agreed with the Purchaser.

5. Delivery time and methods

Delivery is made by specialized couriers with appropriate packaging.

Unless otherwise agreed, delivery will take place within 30 days from the conclusion of the contract.

Any delays will be notified to the Purchaser by email. Delivery times may vary depending on the destination country.

6. Shipping costs

Shipping costs are indicated during the order process, before the order is confirmed.

For deliveries outside the EU, any customs duties and import taxes are borne exclusively by the Purchaser.

7. Product availability

If a product ordered is totally or partially unavailable, the Supplier will promptly inform the Purchaser via email, offering either replacement with an equivalent product or a full refund of the amounts paid.

8. Limitation of liability

The Supplier shall not be liable for delays or failure to perform caused by force majeure, unforeseeable events, or malfunctions attributable to third-party service providers.

In such cases, the Purchaser shall only be entitled to a refund of amounts paid and shall not be entitled to any further compensation.

9. Legal guarantee of conformity

All products sold on Mtrade9 are covered by a 24-month legal guarantee of conformity for consumers, in accordance with applicable consumer protection laws.

The Purchaser must notify any lack of conformity within a reasonable period from its discovery, providing a description and, where requested, photographic evidence.

10. Purchaser’s obligations

The Purchaser undertakes to:

• Pay the price of the products within the terms and using the methods indicated during the purchase process;
• Carefully keep the order confirmation received via email;
• Check the integrity of the packaging upon delivery and promptly report any damage to the courier and to Mtrade9.

11. Right of withdrawal

Where applicable under consumer law, the Purchaser has the right to withdraw from the contract within 14 days from the date of receipt of the products.

To exercise the right of withdrawal, the Purchaser must send a written communication to: info@mtrade9.com.

Products must be returned intact, unused and in their original packaging within 14 days.

Return shipping costs are borne by the Purchaser unless otherwise specified. Refunds are issued within 14 days from receipt of the returned goods or proof of shipment.

12. Product exchanges

The Purchaser may request an exchange, where offered, within 14 days from delivery by contacting info@mtrade9.com.

Return shipping costs for exchanges are borne by the Purchaser unless otherwise indicated by Mtrade9.

13. Processing of personal data

Mtrade9 ensures compliance with applicable personal data protection laws, including:

• Regulation (EU) 2016/679 (GDPR);
• National data protection laws, where applicable.

Personal data will be used exclusively for contractual, administrative, fiscal and legal purposes.

15. Applicable law and jurisdiction

These Terms and Conditions are governed by Italian law, without prejudice to mandatory consumer protections.
